# Terms of Service

These terms govern the use of agenciamelon.com and the Agencia Melón SpA client portal. Please read them carefully: by using the site, you accept them.

## Acceptance

By browsing the site, sending a form or creating a client portal account, you accept these Terms of Service and our [Privacy Policy](https://agenciamelon.com/en/privacy-policy/). If you don’t agree, please don’t use the site.

## What the site offers

agenciamelon.com is an informational and contact site: it shows our work, our services and ways to reach us. Proposals, programs, timelines and prices shown are for reference only and are not an offer. Amounts shown in US dollars (USD) or Brazilian reais (BRL) are approximate conversions: we always invoice in Chilean pesos (CLP).

## Client portal accounts

The client portal is a private space where you follow the progress, tasks and links for your project. Accounts are opened by our invitation or by sign-up, in which case we review them before activating them. By using your account you agree to:

- Provide accurate information and keep it up to date.

- Look after your password and not share it.

- Tell us immediately at hola@agenciamelon.com if you notice any unauthorised use of your account.

We may suspend or close an account used against these terms or the law.

## Projects and hiring

Each project is governed by the proposal or contract we sign with your company, which sets out the scope, timeline, fees and payment terms. If anything in those documents differs from the site, the signed documents prevail. The Melón Discovery call is free and creates no obligation for either party.

## Intellectual property

The content, the Agencia Melón brand, its symbol, the Melón character, and the site’s code and designs belong to Agencia Melón SpA or its licensors and are protected by Chilean Law No. 17,336 on Intellectual Property. You may not copy, distribute, modify or use them commercially without written permission.

Pieces from the Melón Network belong to their authors and are shown with their permission. Client work is displayed as portfolio; rights over each project are governed by its contract.

## Third-party links

The site links to social networks and to client and collaborator websites. We don’t control those sites and aren’t responsible for their content or privacy policies, so we recommend reviewing them.

## Liability

We do our best to keep the site running smoothly and its information accurate, but we can’t guarantee it will be free of errors or interruptions. To the extent permitted by law, Agencia Melón SpA is not liable for damages arising from the use of, or inability to use, the site. None of this limits the non-waivable rights granted by Chilean Law No. 19,496 on Consumer Rights Protection, where it applies.

## Termination

We may suspend or restrict access to the site or the client portal for anyone who breaches these terms. You can stop using them whenever you like and ask us to close your account by writing to [hola@agenciamelon.com](mailto:hola@agenciamelon.com).

## Governing law and jurisdiction

These terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of Santiago, without prejudice to consumers’ rights under Law No. 19,496, including the right to go to the court of their own domicile.

## Changes

We may update these terms. If a change is substantial, we’ll announce it on the site, and by email to account holders, at least 15 days before it takes effect.
