# Privacy Policy

We look after the data you share with us the way we look after a project: carefully and with no surprises. Here’s what we collect, why we use it and how to exercise your rights under Chilean Law No. 19,628 on the Protection of Private Life, as amended by Law No. 21,719.

## Who is responsible for your data

The data controller is Agencia Melón SpA, located at Av. Apoquindo 6410, Of. 606, Las Condes, Santiago, Chile. You can reach us at [hola@agenciamelon.com](mailto:hola@agenciamelon.com) or [+56 9 5142 9796](tel:+56951429796).

## What we collect

Each form asks only for what we need:

- Melón Discovery: name, brand or company, email, WhatsApp, what you need, where your brand is at, timeline, estimated budget and your message.

- Join the network: name, email, city and country, specialty, portfolio link, availability and message.

- Client portal: name, company, email, language and password, which is stored encrypted (we never see it). To protect accounts, we log each sign-in: date, browser and a truncated IP address.

- Site measurement: only if you accept it in the cookie notice, Google Analytics collects pseudonymised browsing data: pages visited, time on site, device type, browser and approximate country or city.

We don’t need sensitive data (such as health, beliefs or ethnic origin), so please leave it out of your messages.

## How we use it

- To answer your questions and schedule your discovery call.

- To prepare assessments, proposals and quotes.

- To manage the projects you hire us for and our relationship with your company.

- To review your application to the Melón Network and contact you when a project calls for your specialty.

- Give you access to the client portal and email you when we post tasks or links for your project.

- Protect the site and accounts against abuse (attempt limits, anti-spam checks and an access log).

- Understand how the site is used in order to improve it, with Google Analytics, only if you accept.

We won’t use your data for anything else without asking for your consent first.

## Legal basis

We process your data with your consent, which you give by ticking the box on each form, and, where relevant, because it is needed to take pre-contractual steps you ask for (such as preparing a proposal) or to perform a contract with you. You can withdraw your consent at any time; this doesn’t affect anything done before.

## Who we share it with

We record enquiries in a CRM and use third-party tools for email, website hosting and client management. If you accept measurement cookies, Google (Google Analytics) receives pseudonymised browsing data, and we may use Cloudflare Turnstile to filter bots in our forms. These providers act as data processors: they may only use the data to provide their service to us and are bound by confidentiality. We never sell or rent your data, and we would only hand it over to an authority when the law requires it.

## International transfers

Some of these providers work in the cloud and may store data outside Chile. When that happens, we choose providers that offer adequate safeguards, such as contractual clauses and security measures in line with what Chilean law requires.

## How long we keep it

We keep your data for as long as our relationship lasts. If your enquiry does not become a project, or your application to the network does not move forward, we keep it for up to 24 months from the last contact and then delete or anonymise it, unless a legal obligation requires us to keep it longer.

Client portal accounts are kept while you have projects with us or until you ask us to close them; the access log is deleted automatically after 180 days. Google Analytics keeps measurement data for a maximum of 14 months.

## Your rights

You can exercise your rights of access, rectification, erasure, objection, portability and blocking at any time. Email us at [hola@agenciamelon.com](mailto:hola@agenciamelon.com) with your name, the right you want to exercise and how we can reply; we may ask you to verify your identity. We will respond within the legal deadlines.

If you’re not satisfied with our answer, you can file a complaint with Chile’s Personal Data Protection Agency (Agencia de Protección de Datos Personales), created by Law No. 21,719 (published in December 2024), whose framework applies from December 1, 2026.

## How we protect it

We apply reasonable technical and organizational measures: encrypted connections, access limited to the studio members who need it, and providers with recognized security standards. No system is foolproof; if an incident ever affects your data, we will let you know and report it to the authority when the law requires.

## Minors

This site is not aimed at anyone under 18, and we don’t knowingly collect their data. If you believe a minor has sent us information, let us know and we’ll delete it.

## Cookies and local storage

We use three kinds of storage in your browser:

- Necessary: if you sign in to the client portal, session cookies keep you signed in, plus the melon_portal cookie, which only says that a session is open. The portal does not work without them.

- Preferences: in local storage we save your language, your currency and your cookie choice; this information is not sent to us.

- Measurement (optional): if you accept them, Google Analytics 4 sets the _ga and _ga_* cookies, which last up to 2 years, to count visits in a pseudonymised way. We do not use them for advertising or profiling.

You can change your choice at any time under “Cookie preferences” at the bottom of the site; if you decline, we delete the measurement cookies from your browser. The site’s typefaces are served from our own server.

## Changes to this policy

We may update this policy to reflect changes in the law or in our services, for example when the new framework under Law No. 21,719 takes effect. We’ll publish the current version here with its date and, if the change is significant, we’ll let you know by email.
